1. Acceptance of Terms

By accessing or using the website https://www.creativeindustrie.in and the services provided by Creative Industrie ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to all the terms and conditions of this agreement, you may not access the website or use any services.

These terms apply to all visitors, users, and customers who access or use our website and services, including but not limited to product inquiries, quote requests, purchases, and communications.

2. Products and Services

• Product Descriptions: We strive to provide accurate descriptions and images of our machinery. However, specifications, colors, and features may vary slightly from the images shown on the website. Actual products may differ due to ongoing improvements and updates.
• Pricing: All prices displayed on the website are indicative and subject to change without prior notice. Final pricing is confirmed only upon issuance of a formal quotation. Prices may vary based on configuration, customization, and order quantity.
• Customization: Many of our machines can be customized to meet specific requirements. Custom orders require detailed technical discussions and will be quoted separately based on specifications.
• Availability: Product availability is subject to stock and production schedules. Estimated delivery times are provided at the time of order confirmation and are approximate.

3. Orders and Quotations

• A quotation submitted through our website does not constitute a binding order. It is an inquiry for pricing and availability.
• An order becomes binding only after written confirmation from both parties, including agreed specifications, pricing, delivery terms, and payment schedule.
• We reserve the right to refuse or cancel any order at our discretion, including orders that appear to be placed by dealers or resellers without prior authorization.
• Order modifications or cancellations must be communicated in writing within 48 hours of order confirmation. Changes after production has commenced may incur additional charges.

4. Payment Terms

• Advance Payment: A minimum advance of 30-50% is required at the time of order confirmation, depending on the product and order value.
• Progress Payment: For custom or high-value orders, additional milestone payments may be required as agreed in the order confirmation.
• Final Payment: The remaining balance must be paid before dispatch or as per the agreed payment schedule. For COD orders, full payment is due upon delivery.
• Late Payments: Payments not received by the due date will attract interest at 1.5% per month on the outstanding amount.
• Bank Details: All payments should be made via NEFT/RTGS/IMPS to the bank account mentioned in our official invoice. We are not responsible for payments made to unauthorized accounts.

5. Shipping and Delivery

• Delivery timelines are estimates and not guaranteed. Delays due to force majeure events, customs, or unforeseen circumstances shall not constitute grounds for cancellation or compensation.
• Risk of loss and title for products pass to the buyer upon delivery to the carrier or at the buyer's premises, as per the agreed Incoterms.
• Any visible damage to the shipment must be reported at the time of delivery and noted on the delivery receipt. Hidden damage must be reported within 48 hours of delivery.

6. Warranty

• Our machines come with a standard manufacturer's warranty as specified in the product documentation and order confirmation.
• The warranty covers manufacturing defects in materials and workmanship under normal use and operating conditions.
• The warranty does not cover damage caused by misuse, neglect, unauthorized modifications, improper installation, use of non-recommended materials, or normal wear and tear.
• Warranty claims must be reported in writing with the machine serial number and details of the defect.
• For warranty service, the customer must provide reasonable access to the machine for inspection and repair.

7. Returns and Refunds

Due to the nature of industrial machinery, returns are generally not accepted once the machine has been delivered and commissioned. Please refer to our Return & Refund Policy for specific conditions under which returns may be accepted.

8. Intellectual Property

All content on this website, including text, graphics, logos, images, software, and product designs, is the property of Creative Industrie and is protected by Indian and international copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our express written permission.

9. Limitation of Liability

To the maximum extent permitted by law, Creative Industrie shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of our website, products, or services. Our total liability shall not exceed the amount paid by the customer for the specific product giving rise to the claim.

10. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Ludhiana, Punjab, India.

11. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemic, government actions, power failures, strikes, or supply chain disruptions.

12. Modifications

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on this page. Your continued use of the website following any changes constitutes acceptance of the new terms.
